When a Watershed Is Already Under Stress, Is Permit Compliance Enough?

As communities across America grapple with the future of agriculture, one question deserves far more attention than it receives:
Should environmental review focus only on whether an individual facility can meet its permit requirements, or should it also consider whether the watershed itself has the capacity to absorb additional impacts?
This question has become especially relevant in west-central Minnesota, where Riverview LLP has proposed expanding its West River Dairy near Morris from approximately 7,855 cows to 18,855 cows. After completing an Environmental Assessment Worksheet (EAW), the Minnesota Pollution Control Agency (MPCA) determined that an Environmental Impact Statement (EIS) was not required and announced it would proceed with issuing the facility's feedlot permit.
The decision has generated significant public discussion—not simply because of the size of the expansion, but because of the condition of the watershed in which it is located.
The Watershed Matters
The proposed expansion is located within the Pomme de Terre River watershed, an area that has been the focus of years of water quality monitoring by the MPCA and local watershed organizations.
The watershed is heavily agricultural. According to the MPCA's Watershed Restoration and Protection Strategy (WRAPS), approximately 87 percent of the phosphorus entering the watershed originates from agricultural land uses, demonstrating how closely agricultural practices and watershed health are connected. The watershed has documented impairments related to phosphorus, total suspended solids (sediment), and E. coli, and recent assessments identified additional lakes and stream reaches requiring restoration planning through the Total Maximum Daily Load (TMDL) process.
These findings do not mean that one farm is responsible for the watershed's condition.
They do demonstrate that the watershed is already experiencing environmental stress from multiple sources and that improving water quality will require continued management across the landscape.
Permits Regulate Facilities—Not Entire Watersheds
This distinction is often misunderstood.
Environmental permits are designed to ensure that individual facilities comply with applicable state and federal standards.
For livestock operations, permits regulate issues such as:
Manure storage
Nutrient management
Land application rates
Stormwater controls
Recordkeeping
Operational requirements
These are essential protections.
However, permit compliance answers a different question than watershed health.
A permit asks:
"Can this individual facility operate within existing regulatory requirements?"
A watershed asks:
"What happens when multiple compliant facilities collectively place increasing demands on the same water resources over many years?"
Those are not the same question.
The Challenge of Cumulative Impacts
Scientific research has long recognized that many environmental problems develop gradually through cumulative loading rather than a single catastrophic event.
Nutrient pollution, sedimentation, declining dissolved oxygen, and algal blooms often result from the combined effects of numerous land uses throughout a watershed over time rather than from one individual source.

This is why watershed scientists spend years monitoring streams, lakes, groundwater, and land use—not simply individual permits.
Why This Matters for Agricultural Growth
Minnesota's agricultural industry is essential to its economy, and dairy producers play a critical role in feeding communities and supporting rural jobs.
Supporting agriculture and protecting natural resources should never be viewed as competing goals.
The question is whether environmental review systems developed decades ago fully account for today's increasingly concentrated agricultural landscapes.
When a watershed already has documented impairments, expanding livestock production may raise broader questions that extend beyond whether one operation can comply with its permit.
Questions such as:
How much additional nutrient loading can the watershed sustainably absorb?
What are the long-term groundwater implications?
How should cumulative manure application across multiple operations be evaluated?
How can environmental review better account for regional agricultural density?
What planning tools help communities balance economic growth with resource protection?
These are planning questions—not accusations.
The Missing Piece: Watershed Capacity
One concept that receives relatively little attention in permit decisions is watershed capacity.
Every watershed has a finite ability to assimilate nutrients, sediments, and other environmental pressures before water quality begins to decline.
Determining that capacity is far more complex than evaluating one permit.
It requires understanding:
Existing water quality conditions
Agricultural intensity
Soil characteristics
Groundwater vulnerability
Hydrology
Existing impairments
Long-term trends
Future growth
Looking at these factors together provides a more complete picture of environmental resilience.
A Better Path Forward
The Veterans & Young Farmers Alliance believes that environmental stewardship and agricultural success go hand in hand.
Rather than replacing existing permitting systems, we believe policymakers should consider complementing them with watershed-based decision-support tools that help evaluate cumulative environmental conditions before major expansions occur.
This is the vision behind the National Farm Risk Management System (NFRMS).
NFRMS is being developed as a science-informed framework that integrates watershed conditions, groundwater sensitivity, agricultural density, conservation practices, infrastructure, and regional resource capacity into a single decision-support model.
Its purpose is not to prevent responsible agricultural growth.
Its purpose is to help communities, farmers, regulators, and policymakers better understand how individual decisions fit within the broader environmental system that supports us all.
Looking Beyond One Project
The conversation surrounding West River Dairy is ultimately about more than one permit or one operation.
It highlights a broader policy question facing agricultural states across the country:
Can environmental review evolve from evaluating individual compliance to also understanding cumulative watershed resilience?
As agriculture continues to modernize, answering that question may become one of the most important challenges in protecting both America's family farms and the natural resources upon which they depend.
